Terms of Service
Last updated: 10/15/2026
1. Acceptance of Terms
By accessing or using LeadGen ("the Service"), operated and provided by Nanops ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access or use the Service.
2. Use of Service & Technical Tool Provider Role
LeadGen provides client-side utility software, productivity tools, schema extraction utilities, browser extensions, and optical character recognition (OCR) camera scanning features designed to help users structure and organize lead data. Nanops operates strictly as a neutral provider of software tools. You agree to use the Service only for lawful purposes and in accordance with all applicable local, national, and international laws.
Important Notice on Data Scraping & Scanning: All scraping of web data and all scanning of documents, cards, or images are performed exclusively at your command and direction. Such actions have nothing to do with Nanops. You assume full legal responsibility for any content you choose to extract, scrape, or scan.
3. Scraping & Scanning: Sole Responsibility of the End User
The scraping, extraction, parsing, or harvesting of data from any website, online portal, directory, search engine, social media platform, or digital service—as well as the scanning, optical recognition, or photographic capture of physical documents, business cards, trade show listings, images, or photos—is fully, solely, and exclusively the responsibility of the end user (customer).
Specifically, you understand and acknowledge that:
- No Association with Nanops: All scraping, querying, and scanning operations are initiated and executed directly by you. Nanops has nothing to do with the selection of target websites, domains, documents, or data sources, and Nanops does not direct, oversee, verify, or endorse any target material you choose to scrape or scan.
- Independent Operation: You operate LeadGen tools independently. Nanops does not own, control, or host the third-party websites or physical documents you interact with, nor does Nanops act as an agent or publisher on your behalf.
- Zero Nanops Liability: Nanops assumes absolutely no responsibility or liability for any consequences, claims, disputes, blocks, legal actions, or regulatory investigations arising from your scraping or scanning activities.
4. Copyright, Intellectual Property & Prohibition on Infringing Content
Customers are strictly advised and cautioned to ensure that they do not scrape, scan, extract, copy, harvest, or distribute copyrighted data from third-party websites, databases, directories, images, or photographs without the express prior written consent or valid license of the respective copyright or intellectual property owners.
In particular:
- Protected Text, Images, and Photos: You are explicitly advised to refrain from scraping or scanning proprietary articles, copyrighted creative works, photographic assets, watermarked images, or protected media.
- Full Customer Responsibility for Infringement: Any incident involving copyright infringement, trademark violation, misappropriation of trade secrets, breach of proprietary database rights, or unauthorized duplication of content is under the full and sole responsibility of the customer.
- No Monitoring by Nanops: Because LeadGen processes data locally or via direct user-initiated calls, Nanops does not and cannot monitor whether your source material is copyrighted. You bear complete legal liability for verifying the copyright status and obtaining necessary permissions before initiating any scrape or scan.
5. Compliance with Third-Party Website Terms & Access Controls
When utilizing LeadGen to interact with websites or online platforms, you are solely responsible for reviewing, understanding, and adhering to the terms of service, acceptable use policies, community guidelines, and robots.txt directives of those target websites. You agree not to use the Service in any manner that:
- Circumvents technical access controls, rate limits, authentication barriers, or paywalls.
- Imposes an unreasonable or disproportionately large load on any third party's infrastructure or causes denial of service.
- Violates anti-hacking, computer fraud, or unauthorized access laws (including the CFAA or equivalent legislation).
6. Privacy Laws, Consent & Data Controller Status
To the extent that any data you scrape, scan, or process contains personal data or personally identifiable information (PII) of living individuals:
- You act as the sole and independent Data Controller under applicable data protection frameworks, including the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and similar global regulations.
- You are exclusively responsible for establishing lawful grounds for data collection and processing, providing necessary privacy notices, honoring data subject requests (such as deletion or opt-out rights), and adhering to anti-spam statutes (such as CAN-SPAM, CASL, or the ePrivacy Directive) when contacting extracted leads.
7. Indemnification
You agree to defend, indemnify, and hold harmless Nanops, its affiliates, licensors, directors, officers, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, regulatory fines, or legal fees (including reasonable attorneys' fees) arising out of or related to:
- Your access to or use of the Service;
- Your scraping, extraction, scanning, storage, or utilization of any data, website content, images, photos, or documents;
- Any claim that your scraping or scanning infringed third-party copyrights, intellectual property rights, privacy rights, or proprietary rights;
- Your violation of any third party's website terms of service or robots.txt policies; or
- Your breach of any provision of these Terms of Service.
8. Termination
We reserve the right to terminate, suspend, or limit your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms, engage in abusive or illegal data harvesting activities, or use the Service in a manner that creates legal exposure for Nanops.
9. Disclaimer of Warranties & Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, statutory, or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of scraped or scanned data.
To the maximum extent permitted by applicable law, in no event shall Nanops be liable for any direct, indirect, incidental, special, exemplary, consequential, or punitive damages (including loss of profits, loss of data, business interruption, or legal penalties) arising out of or in connection with your use of, or inability to use, our scraping or scanning tools, even if advised of the possibility of such damages.
